1. Agreement to terms

By downloading, accessing, or using Rooky, you agree to these Terms of Service and EULA (the "Terms"). If you do not agree, do not use the app. These Terms are between you and RookyTech Inc. (the "Developer", "we", "us"), a company incorporated in Alberta, Canada.

2. Eligibility

You must be at least 17 years of age and legally able to enter a contract to use Rooky. The app is not directed to children.

3. What Rooky is (and is not)

Rooky is a read-only monitoring app. It displays the activity and performance of an automated, paper-trading (no real money) SPY options bot operated by the Developer on the Developer's own private server.

• It is informational and monitoring only. You can view the bot's status, statistics, and history. You cannot place trades through the app.
• It uses paper trading. There is no real money. The bot trades a paper account (no real money). There is no brokerage account for you, no funding, deposits, withdrawals, payments, or in-app purchases. Nothing in the app moves real money or executes a real-world transaction.
• Dollar figures shown are the bot's real paper-account results (no real money at risk), not realized gains or losses in a real-money account.

4. Accounts and sign-in

You sign in with Sign in with Apple, Sign in with Google, or email/password (via Firebase Authentication). You are responsible for keeping your credentials secure and for activity under your account. Most users receive public, read-only access to the bot's stats; a single owner account (the Developer) has limited, authenticated controls over the Developer's own bot. See the Privacy Policy for what we collect.

5. NOT financial, investment, or professional advice

This is important. Please read it.

• Rooky and everything in it are provided for informational and educational purposes only. Nothing in the app is, or should be construed as, financial, investment, trading, brokerage, legal, accounting, or tax advice, a recommendation, or a solicitation or offer to buy or sell any security, option, or other financial instrument.
• The bot's strategy and outputs reflect the Developer's own experimentation in a paper-trading (no-real-money) environment. Paper-trading and past performance is not indicative of future results. Real trading involves substantial risk, including the total loss of capital; options in particular can expire worthless.
• You are solely responsible for your own financial decisions. Before making any real investment decision, consult a licensed professional. The Developer is not a registered investment adviser, broker-dealer, or financial planner, and no fiduciary or advisory relationship is created by your use of Rooky.

6. License grant

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Rooky on Apple devices you own or control, in accordance with the Apple App Store Terms of Service and the Apple "minimum terms" in Section 14.

7. Acceptable use

You agree not to: reverse engineer, decompile, or tamper with the app except as permitted by law; attempt to access another user's data or our systems without authorization; disrupt or overload the service; use the app for any unlawful purpose; or remove any proprietary notices.

8. Intellectual property

Rooky, its design, content, and software are owned by the Developer or its licensors and are protected by intellectual-property laws. These Terms grant you a license to use the app, not any ownership rights.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the app will be uninterrupted, timely, secure, or error-free. Data shown may be delayed, incomplete, or inaccurate. You use the app at your own risk.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP — including any financial or trading decision you make — even if advised of the possibility. Our total aggregate liability for any claim relating to the app will not exceed USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless the Developer from claims, damages, and expenses arising from your misuse of the app or violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access at any time, including for violation of these Terms. You may stop using the app and delete your account at any time. Sections that by their nature should survive (e.g. 5, 8, 9, 10, 11, 13) survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You and the Developer submit to the exclusive jurisdiction of the courts located in Alberta, Canada, except where applicable consumer-protection law gives you the right to bring proceedings in your local courts.

14. Apple App Store — required minimum terms

Because Rooky is distributed through the Apple App Store, the following apply and, in case of conflict with the rest of these Terms, control only as to your use on Apple devices:

• These Terms are between you and the Developer only, not with Apple. Apple is not responsible for the app or its content.
• The license granted is limited to use on Apple-branded devices you own or control, per the Usage Rules in the Apple Media Services Terms.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal/regulatory, or consumer-protection claims.
• In the event of a third-party claim that the app infringes intellectual-property rights, the Developer, not Apple, is responsible for investigation, defense, settlement, and discharge.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and are not on any U.S. Government restricted-party list.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Future features

Rooky is currently read-only and paper-trading (no real money). We may add features over time (for example, connecting your own accounts or new data sources). When we do, we may update these Terms and, for material changes affecting your rights or data, notify you in the app. Continued use after an update means you accept the revised Terms.

16. Changes to these Terms

We may modify these Terms; we will update the "Last updated" date and, for material changes, provide notice. The current version always governs your use.
